Terms and conditions for the use of the University of Lodz learning platform
§ 1

These Terms and Conditions specify the rules for the use of the Moodle learning platform at the University of Lodz managed and supervised by the Commission for Didactic Excellence.

The unit providing technical support for the platform is the IT Centre of the UL.
-
Continuous access to the platform shall be ensured, with the exception of interruptions necessary for maintenance and upgrade works.

Academic teachers and other users participating in the courses are required to observe the copyright and netiquette rules.

A user of the platform may not use the accounts of other users or share their account with others.
-
The UL learning platform may not be used for sharing commercial content, advertisements, announcements and other information not related to the educational process.
§ 2
The following terms used in these Terms and Conditions are defined as follows:

"User" – a person with an active account on the learning platform, i.e. an employee, student, doctoral student of the UL, or a student of postgraduate studies or other forms of education provided by the UL;

"User name" – a unique identifier of the User;

"password" – the User's password which enables access to the learning platform;
-
"User account" – a set of information about a User that is stored on the learning platform, including the scope of authorisations;

"User's personal data" – data stored on the learning platform;
-
"learning platform" – a web-based application used to provide online education;

"learning platform Administrator" – the person(s) appointed by the Director of the IT Centre to: process Users' personal data, administer the resources of the learning platform and grant rights to Users.
§ 3

The learning platform allows for the creation of separate courses which can only be accessed by registered Users, after they have logged in, with the exception of open courses.

User accounts are created by the Administrator of the learning platform.

Participants are registered for a course by the Administrator of the learning platform, an academic teacher with appropriate rights on the platform or on their own using an access key.

Logging of Users to the learning platform takes place through the Central Logging System or with the use of accounts whose credentials, i.e. User name and password, are stored on the platform.

An academic teacher conducting the course has administrative rights, including the creation of course content, sharing teaching materials, and administration of participants.

Participants have the right to use the uploaded learning resources, as well as to upload the content requested by the course tutor.
§ 4
- An academic teacher conducting a course is obliged to:
1) prepare the course schedule and grading criteria and post them on the learning platform before the start of the course;
2) include information on the number of credits or grades earned in the "Gradebook", insofar as this is required by the grading criteria defined for the course;
3) provide answers and advice to questions and concerns raised by
the participants in the form of posts on discussion forums or individual emails;
4)
motivate participants to learn, initiate, moderate and summarise forum
discussions;
5) report new course users to the platform administrator.

The course participant is obliged to:
1) actively participate in classes conducted on the platform according to the rules
and deadlines specified in the course schedule posted on the learning platform;
2) read the educational materials posted on the platform;
3) independently complete tests, assignments and other forms of checking knowledge;
4) hand in their work within the deadlines set by the course tutor;
5) actively participate in discussions on the forums within the course.
§ 5

Content posted on the platform cannot violate the provisions of the Act of 4 February 1994 on Copyright and Related Rights (consolidated text, Polish Journal of Laws of 2019, item 1231, as amended) and other applicable laws.

Unless the posted resources serve to conduct a critical analysis, it is forbidden to publish any contents that:
1)
violate the principles of social interaction;
2)
encourage or advise to commit suicide or self-harm;
3)
threaten others to commit a crime against them or against a person close to them;
4)
insult other nationalities, human races, religions;
5)
incite to commit a crime;
6)
promote a totalitarian system of the state or provoke hatred on the grounds of
national, ethnic, racial, religious differences or of lack of religious
denomination;
7)
are defamatory towards public figures;
8)
contain slander – information incriminating unproven allegations against other
persons;
9)
promote the use of alcohol, drugs or narcotics;
10)
contribute to copyright infringement or violate the copyrights and licences of
third parties;
11)
share personal data, instant messaging IDs, photographs, e-mail address, place
of residence, work, telephone numbers, licence plates and other confidential
information without one's consent;
12)
contain words generally considered offensive.

In accordance with the provisions of the Act on Copyright and Related Rights, materials and resources placed on the UL's learning platform are protected by copyright, and thus their dissemination, reproduction and sharing without the authors' consent is prohibited.

The User may download or print materials placed on the UL's learning platform (texts, graphics, photos, films and the layout of the presented content), provided that they use such information solely for their own learning purposes and do not distribute them.

The development of course materials, including documents placed on the UL learning platform, should be done using legitimate software.
§ 6

Personal data stored on the learning platform will be processed in accordance with the provisions of the law, including: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, the Act of 10 May 2018 on personal data protection (consolidated text, Polish Journal of Laws of 2019, item 1781, as amended), and the Act of 16 July 2004, Telecommunications Law (consolidated text, Polish Journal of Laws of 2019, item 2460, as amended).

The Controller of personal data processed on the learning platform is the University of Lodz with its registered office at Narutowicza 68, 90-136 Łódź, hereinafter referred to as the "Controller".

The Data Protection Officer may be contacted at the mailing address indicated in section 2 with a note: Data Protection Officer, or by e-mail at: iod@uni.lodz.pl.

The User's personal data is processed for the purpose of the teaching process and learning platform (courses/trainings) including contacting the User as part of this process.

The following personal data is processed on the learning platform: name, surname, e-mail address, student index number, USOS ID and IP number.

The User’s personal data will be processed on the basis of applicable provisions of the law (Art. 6 (1)(c) of GDPR), including Act on Higher Education and Science, Labour Code and the University’s internal regulations;

The provision of personal data is voluntary but necessary for the purpose specified in section 4.

Recipients of the User’s personal data are the persons authorised by the Administrator who are responsible for the operation of the learning platform (including the platform’s Administrator). The User’s personal data may be made available to entities authorised under the law or on the basis of relevant agreements concluded with the University.

The User’s personal data will be processed and stored for the period necessary to fulfil the processing purpose specified in section 4. The Administrator, responsible for the operation of the platform, keeps the data of:
1)
students/doctoral students/postgraduate students and students of other forms of
education, together with the history of their activity and materials produced
during the course of studies/other forms of education. After removal from the
list of students/doctoral students/postgraduate students, the account is blocked
(inactive) and the data is deleted after 3 years;
2)
employees, together with the history of their activity and the materials
produced during their employment at the University of Lodz. Upon termination of
their employment at the University of Lodz, the account is blocked and the data
is deleted after 3 years;
3)
other Users together with their activity history and materials produced during
the courses conducted on the platform in which they participated. Upon
termination of the courses, the accounts are blocked and the data is deleted
after 3 years.

The User has the right to:
1)
access their personal data;
2)
rectify the data when they are not accurate;
3)
erase, limit the processing and transfer the data – in cases provided for by
law;
4)
object to the processing;
5)
lodge a complaint to the supervisory authority, which is the President of the
Personal Data Protection Office, based in Warsaw at Stawki 2.

Logging in to the educational platform indicates acceptance of these Terms and Conditions.

The learning platform obtains information about users and their behaviour in the following ways:
1) through the voluntary information entered in the forms,
2)
by storing cookies in the User’s devices,
3)
through the collection of web server logs,
4)
the platform collects information provided by the User in order to carry out the
teaching process.

The platform may also record information about connection parameters (time stamp, IP address).

Information on User behaviour is subject to logging in the server. This data is used exclusively for the administration of the Platform and to ensure the most efficient operation of the provided services.

The learning platform User (in accordance with Art. 173 of the Telecommunications Act of 16 July 2004) has been informed of the installation of cookies on their computer1.
§ 7

Any malfunctions related to the operation of the learning platform should be reported to the IT Centre of the University of Lodz.

The University of Lodz is not responsible for inability to use the learning platform for technical reasons beyond its control.

The University of Lodz is not responsible for any damages incurred by the User as a result of the learning platform malfunctions.

Failure to comply with the Terms and Conditions of the learning platform at the University of Lodz will result in blocking the User's account.

Any information regarding violations of these Terms and Conditions should be reported to the Service Centre for Students and PhD Candidates – Recruitment and Course of Study.
